Ligji q\u00eb i paraprinte p\u00ebsoi 17 ndryshime dhe plot\u00ebsime q\u00eb nga miratimi n\u00eb vitin 2017. Ligji i ri u analizua nga Qendra p\u00ebr komunikime civile n\u00eb publikimin \u201cAnaliz\u00eb e dispozitave antikorruptuese dhe rreziqeve nga korrupsioni n\u00eb Ligjin e ri p\u00ebr furnizime publike\u201d.<\/p>\n<p>Teksti i ri ligjor, u p\u00ebrgatit n\u00eb bashk\u00ebpunim t\u00eb drejtp\u00ebrdrejt\u00eb midis institucioneve dhe organizatave civile n\u00eb at\u00eb fush\u00eb. <strong>Pritet q\u00eb me zgjidhjen e re t\u00eb zvog\u00eblohet hap\u00ebsira p\u00ebr sjellje subjektive t\u00eb organeve kontraktuese, si dhe keqp\u00ebrdorimet e mjeteve publike<\/strong>. Ndryshimet e d\u00ebshiruara n\u00eb k\u00ebt\u00eb drejtim jan\u00eb t\u00eb mund\u00ebsuara p\u00ebrmes m\u00eb tep\u00ebr dispozitave.<\/p>\n<p>Nj\u00ebra nga dispozitat e tilla \u00ebsht\u00eb kontrolli administrativ i cili paraqet mekaniz\u00ebm kontrollues t\u00eb cilin Byroja p\u00ebr furnizime publike mund ta shfryt\u00ebzoj\u00eb \u00e7dokund ku do t\u00eb vler\u00ebsohet se ekzistojn\u00eb rreziqe nga shkelja e dispozitave t\u00eb LFP. <strong>Hap\u00ebrimi para i r\u00ebnd\u00ebsish\u00ebm \u00ebsht\u00eb aplikimi i pes\u00eb dispozitave antikorruptuese n\u00eb Ligjin p\u00ebr furnizime publike <\/strong>t\u00eb cilat do t\u00eb duhej t\u00eb kontribuojn\u00eb p\u00ebr tejkalimin e sfidave p\u00ebr t\u00eb cilat p\u00ebrvoja deri tani ka treguar se paraqiten n\u00eb procesin e planifikimit dhe t\u00eb zbatimit t\u00eb procedur\u00ebs, e deri n\u00eb realizimin e kontrat\u00ebs. K\u00ebto dispozita jan\u00eb t\u00eb inkorporuara n\u00eb nenet prej 33-38, nd\u00ebrsa kan\u00eb t\u00eb b\u00ebjn\u00eb me masat e p\u00ebrgjithshme p\u00ebr pengim dhe paraqitje t\u00eb korrupsionit, ndales\u00eb t\u00eb zbatimi t\u00eb furnizimeve publike nga bart\u00ebsit e funksioneve publike, mbrojtjen e integritetit dhe aplikimin e Ligjit p\u00ebr pengim t\u00eb korrupsionit dhe t\u00eb konfliktit t\u00eb interesave.<\/p>\n<p>Krahas aplikimit t\u00eb dispozitave t\u00eb reja, jan\u00eb t\u00eb dukshme disa rreziqe nga korrupsionit t\u00eb cilat ende ekzistojn\u00eb. <strong>Nj\u00eb nga fushat e tilla t\u00eb rrezikshme \u00ebsht\u00eb zbatimi i furnizimit publik me negociata, e pa publikim t\u00eb shpalljes<\/strong>. Pa marr\u00eb parasysh se LFP jep nj\u00eb shfaqje konkrete n\u00eb t\u00eb cilat raste \u00ebsht\u00eb e aplikueshme si dukuri kjo procedur\u00eb, anekset e kontratave mbeten t\u00eb pa rregulluara n\u00eb m\u00ebnyr\u00eb t\u00eb pa mjaftueshme dhe q\u00ebndrojn\u00eb si pik\u00eb e rrezikshme n\u00eb zbatimin e furnizimit. <strong>P\u00ebrkund\u00ebr zvog\u00eblimit t\u00eb lart\u00ebsis\u00eb maksimale t\u00eb anekseve, kjo mbetet fush\u00eb e cila duhet t\u00eb jet\u00eb n\u00ebn mbik\u00ebqyrje t\u00eb institucioneve kompetente dhe t\u00eb publikut<\/strong>.<\/p>\n<p>N\u00eb raport me favorizimin e operator\u00ebve ekonomik, nd\u00ebrhyrjet n\u00eb nenet 89-94 jan\u00eb hap n\u00eb drejtimin e duhur, nd\u00ebrsa me ata ri-definohen kriteret e nevojshme t\u00eb cilat do ta kishin d\u00ebshmuar aft\u00ebsin\u00eb e operatorit p\u00ebr zbatimin e marr\u00ebveshjes. Prap\u00ebseprap\u00eb, neni 78 i cili e mund\u00ebson ndarjen e tender\u00ebve sipas fushave l\u00eb hap\u00ebsir\u00eb p\u00ebr manipulim dhe favorizim t\u00eb operatorin t\u00eb caktuar ekonomik p\u00ebrmes ndarjes q\u00eb q\u00ebllimshme dhe t\u00eb pa arsyeshme. Si rrjedhoj\u00eb, nevojitet analiz\u00eb e detajuar p\u00ebr rreziqet t\u00eb cilat burojn\u00eb nga ndarja e k\u00ebtill\u00eb e tender\u00ebve.<\/p>\n<p><strong>Teksti i ri ligjor \u00ebsht\u00eb i liberalizuar p\u00ebr nga ana burokratike dhe \u00ebsht\u00eb i harmonizuar me dispozitat e UE, gj\u00eb e cila theksohet edhe n\u00eb raportin e UE t\u00eb vitit 2019. <\/strong>N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, u jep p\u00ebrgjigje problemeve t\u00eb m\u00ebsuara nga zbatimi i deritanish\u00ebm i furnizimeve publike. Me k\u00ebt\u00eb zgjidhje ligjore u jepet pavar\u00ebsi m\u00eb e madhe institucioneve p\u00ebrgjegj\u00ebse, por n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb paraqitet nevoja p\u00ebr fuqizimin e mbik\u00ebqyrjes mbi implementimin p\u00ebrkat\u00ebs t\u00eb ligjit.<\/p>\n<p>\u2014<\/p>\n<p>Projekti \u201cBised\u00eb p\u00ebr luft\u00ebn kund\u00ebr korrupsionit n\u00eb Kuvendin\u201d (Anti-Corruption Talk in Parliament (ACT in Parliament)) p\u00ebrfshin aktivitete hulumtuese dhe p\u00ebrfaq\u00ebsuese me q\u00ebllim par\u00ebsor t\u00eb p\u00ebrkrahjes s\u00eb proceseve reformuese n\u00eb Maqedonin\u00eb e Veriut p\u00ebrmes fuqizimit t\u00eb rolit mbik\u00ebqyr\u00ebs t\u00eb Kuvendit n\u00eb raport me luft\u00ebn kund\u00ebr korrupsionit.<\/p>\n<p>Projekti \u00ebsht\u00eb i p\u00ebrkrahur nga Fondi nacional p\u00ebr demokraci (National Endowment for Democracy \u2013 NED) nga Shtetet e Bashkuara t\u00eb Amerik\u00ebs.
