The Institute for Democracy organized an event that focused on systemic failures related to the construction of the highways of corridors 8 and 10d by the consortium Bechtel and Enka.
At the event, it was established that the entire procedure lacks detailed and in-depth checks of the entities that compete for public tenders. Such checks were missed in this case despite the fact that it is about tenders worth millions. However, by bypassing the process of assessing the impact of the regulation, the implementation of a structured process of consultation with the various stakeholders during the preparation of the legal solution was missed. By doing so, the Rules of Procedure of the Government have been violated.
More pressure is needed to use the protective mechanisms for which implementation is lacking, in order to prevent the exploitation of procedural weaknesses and to create special laws or to amend laws that grant a certain privilege while avoiding potential criminal liability in the future.
